Is it possible that someone who was already convicted of rape in Croatia serves their sentence and stays in the country to commit the same crime again? Apparently, yes! Mohamad Sh., a Pakistani man who was sentenced to four years in prison for rape, was not deported after serving his sentence. And what happened? He raped again – this time a Nepali woman he employed in Croatia.

How is this possible?

According to the County Court in Velika Gorica, the law on foreigners does not provide for automatic deportation after serving a sentence. Deportation can only be carried out after the sentence is served or a deadline for leaving the country is set. Mohamad Sh. applied for asylum in Croatia after his release, which allowed him freedom of movement while awaiting a decision. During this time, he took the opportunity to commit another rape.

A law that protects offenders?

This case reveals serious flaws in the system. While Serbs are deported for showing three fingers, a Pakistani multiple rapist remains in the country and repeats his crimes. The Ministry of the Interior reacted only after learning about his release from prison, but it was already too late.

Lawyer Veljko Miljević points out that the law lacks automatic deportation, which is problematic. In his opinion, legislation needs urgent change to prevent such situations.
