Administrative Court Annuls Illegal Registration of the State as Owner of Solana Bajo Sekulić

The Administrative Court of Montenegro has ruled to annul the illegal registration of the state of Montenegro as the owner of the property of Solana Bajo Sekulić in Ulcinj. The bankruptcy administration of Solana filed a lawsuit after the cadastre registered the state as the owner based on a government decision, although Eurofond, the majority owner, did not pay the market compensation for the shares. The court found that the right to transform ownership rights can only be exercised by the holder of the right to manage or use the land, and that the state did not have the right to automatic registration of ownership without paying market compensation. This ruling returns the property of Solana to Eurofond and emphasizes the importance of respecting legal procedures in privatization and transformation of ownership rights.
