Pakistani citizen Mohamad Sh. was previously sentenced to four years in prison for rape. Although the law clearly states that foreign nationals who have been legally convicted and sentenced to an unconditional prison term longer than one year must be deported, he remained in Croatia. After serving his sentence, he was not deported but continued to live and work in Croatia, where he has now been arrested again for raping a Nepali woman he employed.

On the other hand, a young man from Serbia was immediately found, detained, and charged with a misdemeanor for posting on Instagram while riding a motorcycle and showing three fingers, which the police interpreted as a nationalist symbol. He was also issued a deportation order from Croatia and banned from entering the EU and EEA.

Why Such a Discrepancy?

Lawyer Veljko Miljević explains that deportation is not an automatic process and depends heavily on who initiates the procedure and how it is conducted. In the Pakistani case, the state prosecutor did not request deportation, while in the Serbian case, it was requested immediately. Miljević emphasizes that lawmakers should better regulate this issue and clearly define the criteria for deportation.

The Foreigners Act mandates deportation in cases of serious criminal offenses, but apparently, this is not applied consistently. This case raises serious questions about justice, safety, and equality before the law in Croatia.
