Punishments and Justice Although the law allows up to five years in prison for theft, in practice, first-time offenders often avoid prosecution. Most penalties are fines, and jail time is rare. Germany faces a dilemma – should petty theft due to poverty be decriminalized? Some experts argue this would ease the burden on the justice system, as 8,000 to 9,000 people annually end up in jail for minor offenses.
